Which Article of the Constitution of India safeguards one’s right to marry the person of one’s choice?

Q. Which Article of the Constitution of India safeguards one’s right to marry the person of one’s choice?

(a) Article 16

(b) Article 21

(c) Article 24

(d) Article 29

Answer: (b)

“The right to marry a person of one’s choice is integral to Article 21 (right to life and liberty) of the Constitution”, the Supreme Court said and set aside a 2017 order of the Kerala High Court which annulled the marriage of Kerala Muslim convert girl Hadiya and Shefin Jahan.

Article 21 of the Indian constitution guarantees the right to marry the person of one’s choice. The right to life is guaranteed by the Indian constitution. This privilege can only be taken away by a law that is substantively, procedurally, and substantively fair, just, and reasonable.
